Thanks for using our FeelingBetterNow® Service. The Service is provided by Mensante Corporation (“Mensante”). By using our Service, you are agreeing to these terms. Please read them carefully.

  1. Your FeelingBetterNow® Account

    You need to create an Account in order to use our Service. To protect your Account, keep your password confidential. You are responsible for the activity that happens on or through your Account.

  2. Terms of Service and Privacy

    The data you enter on the Service is subject to the Mensante’s Privacy Policy, available elsewhere on this site. By using our Service, you agree that Mensante can use such data in accordance with our privacy policies.

  3. Ownership and Our Relationship with You

    Mensante and our Service is protected by Proprietary Rights including, but not limited to copyrights, trademarks, service marks, international treaties, Canadian laws and laws of other countries. You agree to abide by all Proprietary Rights and laws. Mensante owns all rights, title, and interest in the Service.

    You may not use content, logos or branding from our Service without Mensante‘s prior written consent.

  4. Warranties, Disclaimers and Liability

    We provide our Services using a commercially reasonable level of skill and care and we hope that you will enjoy using it. But there are certain things that we do not promise about our Services.

    1. Content. The Service is provided solely to assist you and your mental health professional. You should consult your physician or other mental health professional you trust to determine the appropriateness of the information for your specific situation and before making any decision regarding treatment and/or medication.

      The content and resources provided on the Service are not a substitute for the personalized judgment and care of a trained mental health care professional.

      The Service does not make any diagnosis. Only a physician or a psychologist can make a diagnosis.

      The information on this site is derived from DSM-5 and treatment Guidelines of the American Psychiatric Association and Canadian Network of Mood and Anxiety Disorders (CANMAT).

    2. Third Party Websites or Apps. We are not responsible for any third party websites or apps you link to from the Service. You are responsible for reading the third Parties’ own Terms and Conditions and Privacy Policies.

      Any links we provide Third Party websites or apps are provided as a reference to help you identify and locate online resources that may be of interest. These other websites and apps were independently developed by Third Parties and we do not assume responsibility for the accuracy or appropriateness of the information contained at, or endorse the viewpoints expressed at such other sites.

    3. Your Computer or Device. Although we attempt to provide information that is available, uninterrupted, timely, secure, error-free and free of computer viruses or other harmful components, we do not make warranty of it. Anything you download or otherwise obtain through the Service is done at your discretion and risk. We are not responsible for any damage to your computer or loss of data.

    Other than as expressly set out in these terms, neither Mensante nor its suppliers or distributors make any specific promises about the Service. For example, we don’t make any commitments about the content within the services, the specific functions of the services, or their reliability, availability, or ability to meet your needs. We provide the services “as is”.

    Some jurisdictions provide for certain warranties, like the implied warranty of merchantability, fitness for a particular purpose and non-infringement. To the extent permitted by law, we exclude all warranties.

  5. Indemnification

    You agree to indemnify and hold harmless Mensante from any claim or demand, including reasonable attorneys' fees, made by any third party in connection with or arising out of your misuse of the Service or failure to comply with this User Agreement.

  6. Mobile Devices

    Our Service is available on mobile devices. Do not use such our Service in a way that distracts you and prevents you from obeying traffic or safety laws.

  7. Modifying and Terminating our Services

    We are constantly improving our Service. We may add or remove functionalities or features, and we may suspend or stop the Service altogether.

  8. Waiver and Severability

    If you do not comply with the terms of this Agreement, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).

    If it turns out that a particular term is not enforceable, this will not affect any other terms.

  9. Applicable Law

    The laws of Ontario, Canada will apply to any disputes arising out of or relating to these terms or the Service.
